Kristina Marie Winston, 24, and Noah James Haggerty, 20, were indicted Wednesday by a Bell County grand jury. They were jailed on $1 million bond each after the death of their son in April.
On April 18, Killeen police responded to a call that an infant was not breathing.
Isaiah Haggerty was taken in critical condition to Metroplex Hospital in Killeen and transferred to the pediatric intensive care unit at Scott & White Hospital in Temple.

According to the arrest affidavit, a few days before Isaiah's death, Monica McMillan, a neighbor, saw him and told Winston the baby needed to see a doctor. McMillan said that Winston told her that she couldn't take him because the doctor would see the bruises and call Child Protective Services. Source: Killeen Daily Herald
While it's a bit unusual for them to have been indicted for a lesser charge, they can always be re-indicted later should the prosecutor's feel they can prove the elements of a Capital Murder charge. Injury To A Child is a 1st Degree felony so this is still a pretty serious charge.
